Payments

You authorize Gedene to instruct your card issuing financial institution to charge your card account in accordance with the terms of our agreement with you.

Payment for the items in your cart will be made on the order due date and time. Gedene defines the order deadline as 23.45 hours two calendar days before the delivery date.
Payment will be received as follows:

When you create your account and add your payment card, payment for all items in your cart is taken instantly.
For your first order, any additional items added to your cart between creating your account and finalizing your order will be charged one day before your order is delivered.
For subsequent orders, payment for all items in your cart will be taken at order cut-off one day before the delivery date of your order.

Each time you change your order on the website, in the app or through customer service, you will be able to see on the website or in the app the amount that will be taken as payment for your next delivery. Gedene will also send you an email informing you about the order items and the amount to be taken as payment, unless you opt out of receiving these emails.

Gedene will notify you by email on the day your order is finalized regarding the content of your order and the payment amount to be received in case your order does not change. You may modify or cancel your order at any time before the order is finalized.

Gedene will send you an email with each payment attempt. The email will indicate whether the payment was successful or not.

Ordering and purchasing

Orders placed with Gedene may be subject to acceptance based on the minimum spend published on our website (here). Gedene reserves the right to change existing minimum spend conditions or introduce new minimum spend conditions, which will be published on our website.

All orders you place on our website will be automatically transmitted to us during the order closing times published in the ‘frequently asked questions’ section on our website (making your account work for you, placing an order). You are authorized to modify, correct and cancel your order up to such cut-off time and by authorizing the placement of an order with us, you confirm that you have made such corrections and cancellations and you are entering into a contract to purchase products from us. . You may not cancel or withdraw your order or any part of it except in accordance with 4.10 and 6.3 below.

While we endeavor to deliver all accepted orders, our products are subject to availability and we cannot always know at the time of acceptance of an order whether a product is or will be ready for delivery. If we are unable to deliver a product you have ordered, we may offer a reasonable substitute product. You may refuse this substitute and you will not be charged for it or, if payment has already been received, you will be refunded the amount paid for that product. Where we do not offer a substitute product, the product will be removed from your order and again you will not be charged for it or, if payment has already been made, you will be refunded the amount paid for that product. We will accept no responsibility for the unavailability of our products.

All products we offer are subject to seasonal availability and supply price changes. Therefore, if you set up a regular (recurring) order for a product or products, the price of those products will change over time from the time you first place an order. You agree that the price payable for all products in your order will be the price stated on the website at the time the order is placed in accordance with 4.3.

Where a product is displayed on our website at an incorrect, inaccurate price, we reserve the right to remove that product from your order, replace it with the correct one or not deliver the product and refund the price paid.

All prices displayed on the Website are inclusive of all applicable taxes and duties (including VAT).

Ordering and purchasing

We will deliver to the address specified in your Gedene account (also referred to herein as “home”).

We reserve the right not to deliver to all locations or not to deliver all products to all locations. If we are unable to deliver to your address, you will be notified during the account creation process. Where we are unable to deliver certain products to your address, you will not be able to use them (both on the website and over the phone) for you to order.

It is your responsibility to make appropriate arrangements to receive your delivery. The delivery details section of your account is important as it allows you to leave instructions at a convenient place where your delivery can be left if you are not at home to collect the goods that form part of our contract under these terms and conditions. It is important that you provide a suitable means (at your cost) to keep any goods we deliver that need to be refrigerated below 8oC until such time as you can cool them.

Once your delivery instructions have been followed and completed by us, you acknowledge that the goods delivered belong to you. Where delivery instructions have been followed, we will not accept any liability for damage to or theft of your goods and we will not accept any liability for any incident which may arise as a result of the theft of or damage to such goods.

The time your order is delivered that day will vary from week to week depending on traffic, weather and the number of deliveries that day. If you order regularly, you may find that your delivery occurs at a similar time each week, but we do not guarantee this time and we accept no liability for inconvenience or loss as a result of deviation from this time.

We cannot accept liability for any inconvenience or loss where we are unable to deliver to you or deliver late for reasons beyond our control (e.g. adverse weather, vehicle breakdown, traffic congestion, strike action, supplier failures, acts of God). We will, of course, refund you for any part of your order that is not delivered or is compromised due to delay.

To minimize our carbon footprint, Gedene reserves the right not to provide a printed receipt with your delivery. Your delivered goods and their cost can be viewed online through your Gedene account.

You must check your goods as soon as possible after delivery and notify us immediately of any faults. We will refund you for any goods that are not ordered, are faulty, are replaced with a product that is unacceptable to you or are delivered without us complying with these terms and conditions. However, this liability will be limited to the value of the faulty and/or undelivered goods.

Warranties and applicable law

We guarantee that our products will be in satisfactory condition and quality (excluding defects caused by your misuse, negligence or accidents while the goods are in your possession). Please let us know if you are not satisfied with any of our products. If upon inspection they are found to be defective or faulty, we will gladly refund you the price you paid for them.

We accept no responsibility for representation, including unforeseen losses and losses to a business (loss of reputation, profits, trade or business opportunities).

Our entire liability under these terms and conditions shall not exceed the purchase price of the goods in question. This does not include the provisions we make under 5.10 in relation to holding your keys. Furthermore, nothing in these terms and conditions shall limit our liability to you for death or personal injury caused by our negligence or that of our employees, agents or subcontractors.

We will not be liable for any delay or failure to perform our obligations due to events beyond our reasonable control, including but not limited to energy supplies, equipment or supplier failure, road traffic problems, terrorism or war, fire, adverse weather conditions, acts of God, strikes, labor disputes, civil unrest, accident, business interruption.

You do not have the right to assign, sublicense or otherwise transfer any of your rights under these terms and conditions.

These terms and conditions are governed by and construed in accordance with the laws of Turkey and the courts of Turkey shall not have exclusive jurisdiction over any dispute arising in relation to these terms and conditions.

If any of the provisions in these terms and conditions are found by a court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the other provisions under these terms and conditions.
